1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the Music Jump game, website, web store, support channels and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be legally capable of entering into these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you and supervise your use. You may not use the Services where access is prohibited by applicable law.
3. Accounts and Player Information
Some features require a player profile or verified email. You are responsible for providing accurate information, keeping access credentials secure and all activity under your account. Notify us promptly if you suspect unauthorized access. We may require additional verification before providing account or purchase support.
4. License to Use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for lawful entertainment purposes. The Services are licensed, not sold. No rights are granted except those expressly stated in these Terms.
5. Virtual Items
The Services may offer Beat Credits, ball skins or other virtual items. Virtual items are licensed digital content, have no cash value, are not legal tender and may not be transferred, traded or redeemed for money unless applicable law expressly requires otherwise. We may manage, modify or discontinue virtual items to operate, balance or update the Services, subject to applicable law.
6. Purchases, Payment and Refunds
Prices, currency and available payment channels are shown before checkout. You authorize the selected payment provider to charge the displayed amount and are responsible for applicable taxes and fees. Payment providers may apply additional terms. Except where required by law or stated in a separate refund policy, completed purchases of delivered digital content are final. For duplicate, unauthorized or undelivered orders, contact service@vantagepeakstudio.com with the player email, order identifier, purchase date and amount. Do not include full card credentials.
7. Acceptable Conduct
You may not cheat; automate gameplay; exploit defects; interfere with service security; reverse engineer except where law permits; distribute malware; impersonate another person; misuse payment methods; commit fraud; harass others; or use the Services in a way that infringes rights or violates law. You must not sell, rent or transfer accounts or virtual items outside features expressly provided by us.
8. Music, Artwork and Intellectual Property
The Services and their software, music, sound recordings, artwork, characters, text, trademarks, interfaces and other content are owned by us or our licensors and are protected by intellectual property laws. You may not copy, publish, synchronize, broadcast, extract, remix or commercially use that content without authorization. Third-party names and marks remain the property of their respective owners.
9. Feedback and User Submissions
If you submit feedback, suggestions or support materials, you confirm that you have the right to provide them. You grant us a worldwide, royalty-free license to use feedback to improve and operate the Services, without an obligation to compensate you. This does not transfer ownership of your personal information, which remains governed by the Privacy Policy.
10. Third-Party Services
The Services may link to app stores, payment processors or other third-party services. We do not control those services, and their own terms and policies apply. We are not responsible for third-party content, availability, security or transactions except to the extent required by law.
11. Availability and Updates
We may update, rebalance, suspend or discontinue all or part of the Services for maintenance, security, legal, commercial or technical reasons. Updates may change features, music, virtual items, compatibility or system requirements. We do not guarantee that every feature or track will always remain available.
12. Suspension and Termination
You may stop using the Services at any time. We may restrict, suspend or terminate access where we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud, or where necessary to protect users or the Services. Sections that by their nature should survive termination will remain effective, including intellectual property, disclaimers, liability and dispute terms.
13. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
14. Limitation of Liability
To the fullest extent permitted by law, we and our affiliates, licensors and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, loss of data, revenue, profits or goodwill arising from the Services. Where liability cannot be excluded, our aggregate liability will be limited to the greater of the amount you paid through the Services in the six months before the event giving rise to the claim or the minimum amount required by law.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from third-party claims, losses and reasonable costs arising from your unlawful use of the Services, breach of these Terms or infringement of another person's rights. This obligation does not apply where prohibited by consumer law.
16. Governing Law and Disputes
These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law principles. Before filing a formal claim, you and we agree to make a reasonable effort to resolve the issue informally by contacting service@vantagepeakstudio.com. Any mandatory consumer protection rights and rights to bring claims before competent local courts remain unaffected.
17. Changes to These Terms
We may update these Terms to reflect changes to the Services, law or business operations. The revised Terms will be posted with a new effective date. Where required, we will provide additional notice. Continued use after the effective date constitutes acceptance to the extent permitted by law.
18. General
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a corporate transaction or service transfer, subject to applicable law.
